Mechanism and Rules for the Election

Composition of the Abu Dhabi Chamber of Commerce & Industry (ADCCI) Board of Directors

According to the Chamber Law No. 27 of 2005, the Board of Directors (BoD) is composed of twenty-one members, and an emiri decree shall be issued appointing six thereof, including two female members, plus fifteen elected members, including two foreign ones to be elected by Chamber expatriate members.

Board of Director’s Term of Membership

 Membership of the Board of Directors shall be for four years.

 I. Call for Election-related Regulations & Procedures

1. Names of those whose applications for running for the membership of the Board have been accepted shall be announced in newspapers, following the obtainment of required approval from competent authorities; and the Chamber shall, after a voter’s form has been completed and voting card secured, call upon its members to attend the election at the station and time specified for this purpose.

2. The names of candidates shall be arranged alphabetically.

 


II.Who Has the Right to Vote? What are the Voting-related Terms and Conditions?

1. He who has a valid membership  and paid relevant fees at the time of  convening  the General Assembly meeting for election either in the first or second round. Votes shall be as multiple as the number of memberships in the Chamber and one vote shall be counted for each and every branch with the Chamber.

2. Each membership – be it basic or branch-related- with all relevant annual fees already paid shall have one vote. If a license includes more than one person, they will have to identify their representative by virtue of a letter to be addressed to the Chamber at least ten days prior to date of the election.

3. A voter’s form available at branches of the Chamber should be completed and a voter’s card obtained.

4. An ID proof should be produced.

5. Pursuant to terms and conditions specified under Article 13 of the Chamber Law, a member shall have the right to vote by proxy, provided that an agent shall have no more than one vote (i.e. only one proxy involving one vote). It is also a prerequisite for an agent to be originally a Chamber member and for the power of attorney to be notarized by the Notary Public.

6. As for branches of foreign companies and representative offices holding the Chamber membership, a person authorized to act for a membership and who is both duly registered with and accredited by the Chamber should be present in person for the purpose of voting. This shall apply to any membership issued in a legal form other than those mentioned above.

7. An authorized agent or legal guardian shall vote in person on behalf of partners in companies or businesses represented by the authorized agent or legal guardian conditional on notifying the Chamber thereof ten days prior to the election date.

8. The right to vote shall be abated in case of failure to show up on the date and at the location specified for holding the elections and membership should be valid in the first and second rounds.

9. It shall be necessary to report personally to the appointed location of the election for the purpose of voting, that is to say; voting by fax, mail or otherwise will not be accepted.

10. If the quorum has not been fulfilled in the first round of elections, those who have cast their votes will have to re-attend at the second one for purposes of voting, as all the voting procedures which took place in the first round shall be deemed null and void.

11. If a member did not attend the first round, he may attend the second one.

12. The right to vote shall abate with regard to memberships renewed on the election day and date of both the first round and the second one.

13. The polling station shall be in the city of Abu Dhabi, Al Ain and Bida’a Zayed and elections shall be conducted concurrently.

 

III. Conditions and Procedures Related to Voting

1.Prior to the commencement of the voting process, the Elections-Supervising Committee shall verify that ballot boxes do not contain any paper, locking the same with its own knowledge and testing the e-elections method at all polling stations.

2.A conditional vote or one implying any mark or sign shall be deemed null and void and voting that includes more than the number required to be elected shall be revoked, given that the electronic progamme will not allow it.

3.The date of the elections at the three stations has been determined to be on 7th December 2009 as from 8:00 a.m. to 9:00 p.m.; and the Elections-Supervising Committee may extend the duration of voting until the electoral process has been announced to have come to an end and relevant results issued posterior to getting such results’ turnout. The meeting shall be valid if it has been attended by a quarter of the number of the ADCCI General Meeting / Assembly members, who have paid their respective 2009/2010 membership fees at all three stations. In the event of an unfulfilled quorum, a second meeting shall be convened at least a fortnight posterior to the date of the first one and the second meeting shall be valid irrespective of the number of attendees at the three stations.

4.Report to the voting station (using a ‘Voter's Card’) as it shall be impermissible to vote by fax or by mail.

5.Thriteen UAE members shall be elected by the UAE members and expatriate ones shall elect 2 expatriate members.

6.Enter the voting hall and proceed to the voter's voting screen.

7.Enter the number of the voter's card into the ballot device.

8.Once the voter's personal details and candidates' photographs and names have appeared, click the photograph of the person elected by the member.

9.Make sure of the selection made by pressing the key confirming it.

10.The computer system shall automatically print an election paper/card containing the names of candidates selected by the voter.

11.The member shall withdraw the printed card, signing and depositing the same into the box appointed thereto.

12.All this shall be done under the supervision of both the committee formed to oversee the elections and the Chamber’s representative.

13.Posterior to the completion of the voting and counting processes, winners shall be declared by Chairman of the Committee, and the Judge, who is the Chairman of the Elections-Supervising Committee, shall write a procés-verbal in which he should indicate the date and timing of the elections, the number of voters, the names of all candidates and the number of votes captured by each and every one of them. Members who have not won shall be deemed as reserve for board members elected in the same round of elections only.

14.In case of a tie between two or more candidates, the Chairman of the Elections-Supervising Committee shall draw lots to determine the winner out of them.

15.Those in charge of steering the voting process shall help illiterate or blind voters or ones with special needs complete the voting process.

 

IV.Controls of Candidates’ Election Campaigns

1.The election campaign shall start after the final list of candidates has been announced and end concomitantly with the end of office hours before the appointed deadline for the elections and in accordance with the timetable set for elections on 7th December 2009. It shall be prohibited for candidates for ADCCI Board membership to carry out any of the following acts: 

•The use of the official state emblem or symbols in meetings, election advertisements and flyers as well as in all types of writings and drawings used in the election campaign.

•No candidate may use his advertising campaign for purposes other than the one allotted thereto; namely, making promotion for both his candidature and election program.

•It shall be impermissible to use schools, universities, places of worship, hospitals or government and semi-government buildings by way of publicity in favour of a candidate.

•Loudspeakers shall not be used in activities of the election campaign except in the rooms and halls earmarked for this purpose.

•A candidate shall be prohibited from behaving or acting unlawfully as well as from direct or indirect verbal transgression or abuse against other candidates. Publicity shall not include words, letters, statements, or propaganda leaflets to the detriment of any other candidate.  The candidate must also take into account the role required from a member of the ADCCI Board of Directors so as for the candidate’s election campaign not to include promises or programs outside the functions and powers of the ADCCI board member.

•It shall be prohibited for candidates to paste leaflets, advertisements or any kind of writing, drawings and pictures on all types of cars or vehicles unless the same has been duly licensed from the competent authority.

•The candidate shall be committed to maintain the environmental assets and the aesthetic landscape of the Emirate of Abu Dhabi.

•The candidate shall be prohibited from offering the ADCCI member-voters gifts, be they in-kind or material ones, in order to obtain their votes.

•The candidate shall have the right to conduct an election campaign to promote his candidacy, provided that public behavior, ethics and customs and the laws in force be observed.

•Applicable systems and regulations, whether exiting or due to be issued by the Elections-Supervising Committee, should be adhered thereto. 

•Candidates shall be prohibited – barring only while casting their votes - from entering into the election hall during polling hours.

2.Candidates shall have the right to present their election programs in the local audio, video and printed media as well as to hold seminars and press conferences in conformity with the regulations in place.

3.All candidates shall be prohibited from conducting any election propaganda involving any fraud or deception towards voters. It shall also be banned to use a technique of touching others on the raw or defaming them as part of the electoral campaign.

4.The Elections-Supervising Committee related to the ADCCI Board Members’ 2010 elections has been formed under the chairmanship of the Judge seconded from the Judicial Department, His Excellency the Advisor Ahmed Ibrahim Al Zaabi, along with the following as members thereof:

o          Mr. Mohammed Omar Abdullah,

o          Ms. Mariam Mohammed Abdullah Al Romaithi,

o          Dr. Jassim Ali Al Shamsi,

o          Mr. Mohammed Rashid Alneaimi, and

o          Mr. Obaid Sultan Al Dhaheri.

5.The Elections-Supervising Committee shall be entrusted with considering and reviewing violations that might be prejudicial to the progress of the elections or interrupt the application of relevant instructions issued. The Committee may inflict the following penalties:

•Approving or disapproving the applications for nomination,

•Developing the election’s regulations and mechanism and supervising carrying the same into effect,

•Issuing warnings of exclusion from the list of candidates for board membership,

•Removing the candidate's name from the list of candidates for board membership,

•Abolishing any vote,

•Cancelling the election result and announcing the time allowed for the election or its extension, and

•Responding to any objections or appeals / challenges.
